Terms and Conditions

Siacle is a B2B travel distribution platform built to enable faster, safer, and easier travel booking for travel agencies across the globe. We connect travel startups with world-leading Destination Management Companies and will allow them to access the world market at their fingertips. Siacle is developed by Raftel International Private Limited, a travel technology company based in Karnataka, India.


Web Application Terms of Service

Please read these web application Terms of Service carefully before using the web application (Siacle). These Terms of Service govern your access to and use of the web application. The web application is available for your use only if you agree to the Terms of Service set forth below. If you don’t agree to all the Terms of Service, do not access or use the web application. By accessing or using the web application, you and the entity you represent (“you” or “your”) signify your agreement to be bound by the Terms of Service. Supplier refers to third-party service providers we partnered with, including but not limited to DMCs, Hotels, Tour Operators, Cab Services, Flight Providers and other travel service providers.
Supplemental Terms of Service or documents that may be posted on the web application from time to time are hereby expressly incorporated herein by reference. At our sole discretion, we reserve the right to make changes or modifications to these Terms of Service at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of these Terms of Service and alerting you by Email when we make a significant change.


Intellectual Property Rights

Unless otherwise indicated, the web application is our proprietary property. All source code, databases, functionality, software, web application designs, text, and graphics on the web application (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us and are protected by copyright and trademark laws and various other intellectual property rights.

We provide individual sellers to upload photographs, videos, and other reference materials to represent their services better. We are not liable for the accuracy or the proprietary ownership of such content. We respect the intellectual property rights of others. If you believe that any material available on or through the web application infringes upon any copyright you own or control, please immediately notify us at admin@siacle.com. If and when such an issue is reported to us, we are willing to take it down without having to inform the individual who uploaded the content within a reasonable amount of time.

The Content and the Marks are provided on the web application “AS IS” for only your information and personal use. Except as expressly provided in these Terms of Service, no part of the web application and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
Provided that you are eligible to use the web application, you are granted a limited license to access and use the web application and to download or print a copy of any portion of the content to which you have properly gained access solely for your personal and client’s use. We reserve all rights not expressly granted to you in and to the web application, the Content, and the Marks.


User Representations

By using the web application, you represent and warrant that:

    1. All registration information you submit will be true, accurate, current, and complete.

    2. You will maintain the accuracy of such information and promptly update such registration information as necessary].

    3. You have the legal capacity, and you agree to comply with these Terms of Service.

    4. You are not a minor in the jurisdiction in which you reside.

    5. You will not access the web application through automated or non-human means, whether through a bot, script, or otherwise.

    6. You will not use the web application for any illegal or unauthorized purpose.

    7. Your use of the web application will not violate any applicable law or regulation.

Suppose any of the provided information is untrue, inaccurate, not current, or incomplete. In that case, we have the right to suspend or terminate your account and refuse any current or future use of the web application (or any portion thereof).


User Registration

You are required to register with the web application. You agree to keep your password confidential and will be responsible for all use of your account and password. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure. You should inform us immediately if you have any reason to believe that your password has become known to anyone else or if the password is being, or is likely to be, used in an unauthorized manner. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.


Access To Siacle.com

We will do our utmost to ensure that the website’s availability will be uninterrupted and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction.


Prohibited Activities

You may not access or use the web application for any purpose other than that for which we make the web application available. The web application may not be used in connection with any commercial endeavours except those specifically endorsed or approved by us. As a user of the web application, you agree not to:

    1. Systematically retrieve data or other content from the web application to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.

    3. Circumvent, disable, or otherwise interfere with security-related features of the web application, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the web application and/or the content contained therein.
    4. Engage in unauthorized framing of or linking to the web application.
    5. Trick, defraud, or mislead other users and us, especially in any attempt to learn sensitive account information such as user passwords;
    6. Make improper use of our support and services or submit false reports of misconduct.
    7. Engage in any automated use of the system, such as using scripts to send comments or messages or using any data mining, robots, or similar data gathering and extraction tools.
    8. Interfere with, disrupt, or create an undue burden on the web application or the networks or services connected to the web application.
    9. Attempt to impersonate another user or person or use the username of another user.
    10. Sell or otherwise transfer your profile.
    11. Use any information obtained from the web application to harass, abuse, or harm another person.
    12. Use the web application as part of any effort to compete with us or otherwise use the web application and/or the content for any revenue-generating endeavour or commercial enterprise.
    13. Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the web application.
    14. Attempt to bypass any measures of the web application designed to prevent or restrict access to the web application or any portion of the web application.
    15. Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the web application to you.
    16. Delete the copyright or other proprietary rights notice from any Content.
    17. Copy or adapt the web application’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
    18. Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the web application or modifies, impairs, disrupts, alters, or interferes with the service, features, functions, operation, or maintenance of the web application.
    19. upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “PCM”).
    20. Except as may be the result of a standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the web application, or using or launching any unauthorized script or other software.
    21. Disparage, tarnish, or otherwise harm, in our opinion, us and/or the web application.
    22. Use the web application in a manner inconsistent with applicable laws or regulations. 


Governing Laws

The laws of India, excluding its conflicts of law rules, shall govern this agreement and your use of our service. Your use of our service may also be subject to other local, state, national, or international laws.


Web Application Management

We reserve the right, but not the obligation, to:

    1. Monitor the web application for violations of these Terms of Service;
    2. Take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Service, including without limitation, reporting such user to law enforcement authorities;
    3. In our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof;
    4. In our sole discretion and without limitation, notice, or liability, to remove from the web application or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems;
    5. Otherwise, manage the web application in a manner designed to protect our rights and property and to facilitate the proper functioning of the web application.


Services Availability and Purchase Terms

    1. The cost mentioned by the supplier is final.
    2. The cost mentioned by the supplier may change without prior notice. 
    3. Booking, Payments, Amendments - Terms & Conditions are solely based on the Supplier. It may vary from time to time. 
    4. Refund policies are based on the supplier. 
    5. The supplier has rights reserved to accept, reject and amend the booking. The supplier can revise the rates based on the negotiations. Siacle has no role to play in it.
    6. Travel Agents shall check the Terms and Conditions, Refund policies, etc., to avoid further confusion in the booking. 
    7. For all International bookings, travel agents are expected to upload fellow passengers’ necessary documents, i.e., PAN Details, Passport, VISA, Flight Tickets, etc., in failure of uploading or producing such mandatory documents by the travel agents, the supplier holds the right to terminate or abort the booking. 
    8. Siacle takes no responsibility for hosting any fellow passengers in any country. The concerned supplier is responsible for all kinds of bookings accepted by the travel agents. 
    9. Travel agents shall hold valid GSTIN and PAN, and the same shall be furnished at the time of registration.
    10. Travel agents shall hold valid Bank accounts, and the details shall be shared with Siacle to link and create a Virtual Account wallet.


Privacy Policy

We care about data privacy and security. Please review our Privacy Policy by visiting the link in the footer of siacle.com landing page. By using the web application, you agree to be bound by our Privacy Policy, which is incorporated into these Terms of Service. Please be advised the web application is hosted in India.
Suppose you access the web application from the European Union, Asia, the United States, or any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in India, then through your continued use of the web application. In that case, you are transferring your data to India, and you expressly consent to have your data transferred to and processed in India.


Limitations Of Liability
    1. Nothing in these Terms of Service will: 
        a) Limit or exclude our or your liability for fraud or fraudulent misrepresentation; or 
        b) Limit or exclude any of our or your liabilities in any way that is not permitted under applicable law.
    2. We are not liable to you in respect of any losses arising out of events beyond our reasonable control.
    3. To the maximum extent permitted by law, Siacle accepts no liability for any of the following:
        a) Any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill, or commercial opportunities;
        b) Loss or corruption of any data, database, or software;
        c) Any special, indirect, or consequential loss or damage.
    4. Siacle is not to be held liable for any affairs to do with passenger safety.


Term And Termination

These Terms of Service shall remain in full force and effect while you use the web application. Without limiting any other provision of these Terms of Service, we reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the web application (including blocking specific IP addresses) to any person for any reason or no reason, including without limitation for breach of any representation or trust or the covenant contained in these Terms of Service or of any applicable law or regulation. We may terminate your use or participation in the web application or delete your account and any content or information you posted at any time, without warning, at our sole discretion.
Suppose we terminate or suspend your account for any reason. In that case, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party.
In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including, without limitation, pursuing civil, criminal, and injunctive redress.


Fees And Payment

Concerning any credit card or other payment processing details you have provided us, we commit that this confidential information will be stored in the most secure manner possible. You must pay any applicable taxes and third-party fees. We are not responsible for these fees. We may take steps to collect the fee you owe us. If you are located outside of India, your payments will be made to a foreign entity.


Cancellation and Refund Policy

Siacle is an aggregator platform and we follow the Supplier’s cancellation and refund policy. You’re requested to read the Supplier cancellation and refund policy before initiating a booking. For those bookings without a defined cancellation policy, the Siacle cancellation and refund policy apply. You may request to cancel your booking for a full refund, up to 30 days before the date and time of your customer’s travel. Cancellations between 29-15 days before the trip will incur a 50% cancellation fee. Cancellation requests made within 15 days of the travel date/time may not receive a refund. However, Siacle will try to get you the best refund terms as per the Supplier terms after discussing them on a case-to-case basis.
Once a cancellation request is successfully approved by both Siacle and the Supplier, you’ll receive a wallet credit of the agreed amount within 7 working days. You may request a withdrawal of the same to your bank account using the withdraw button in the wallet page. Every withdrawal request is processed in under 2 business days by our team. Once processed and ini tiated the withdrawal, money will be credited to your bank account instantly via IMPS or NEFT. However, it may take up to 7 days for the amount to be reflected in your bank account due to operational delays.
